Paris Arbitration Week x Club de l'arbitrage


Held last week, on March 25, 2026, at OCA, during Paris Arbitration Week, the Club de l'arbitrage organised a discussion on “Loyauté de la preuve” and fairness in the taking of evidence in international arbitration: a comparative perspective.

Featuring contributions from Professor and Arbitrator Denis Mouralis, Barrister at Clay Arbitration Obioma Ofoego, Senior Group Legal Counsel at Veolia Romain Sellem, and Financial Expert at OCA Mikael Ouaniche, and moderated by Natalia Gaucher, President of the Club de l'arbitrage, the panel explored how evidentiary practices shape arbitral proceedings.

Although evidentiary matters in arbitration are sometimes viewed as secondary, they can rapidly become decisive. The discussion highlighted how the collection, disclosure, and examination of evidence directly influence the fairness of the proceedings.

The session brought together a variety of approaches, moving from recent French case law and common law conceptions of procedural fairness to more practical considerations, including document retention within companies and the role of experts in arbitral proceedings.

These exchanges underscored the concrete impact of evidentiary practices in arbitration: they shape how parties present their cases, guide tribunals in their evaluation of the record, and ultimately inform the understanding of procedural fairness.
