We bring together academics, judges, legal practitioners, professionals, and students from all backgrounds, in France and around the world.

Our mission? To make arbitration better understood, more widely used, and fully connected to today’s major economic, social, and legal challenges.

Paris Arbitration Week x Club de l'arbitrage


The Club de l'arbitrage is delighted to welcome you to a discussion organized as part of Paris Arbitration Week on the topic of "Loyauté de la preuve" and fairness in the taking of evidence in international arbitration: a comparative perspective.

In two landmark decisions of 22 December 2023, the Cour de cassation introduced a proportionality test allowing courts to admit evidence obtained disloyally when it is essential and proportionate.

What does this mean for international arbitration? What are the solutions adopted by arbitral tribunals, parties, counsels and experts and how might they be influenced according to the legal culture and the applicable law?

Join us for a dynamic discussion on the evolving balance between fairness and evidentiary necessity in international arbitration, led by a distinguished panel of speakers:
- Obioma Ofoego, Barrister and Co-Head of English Law Practice at Clay Arbitration ;
- Romain Sellem, Senior Group Legal Counsel at Veolia ;
- Mikael Ouaniche, Financial Expert at APCEF - Association des Professionnels du Contentieux Economique et Financier ;
- Denis Mouralis, Professor of Law at Aix-Marseille Université and arbitrator ;
- Natalia Gaucher, President of the Club de l'arbitrage.
